Registration for Marriage Between Shanghai Residents and Overseas Chinese, Residents of Hong Kong and Macao
Processed by: Marriage Administration Section of Shanghai Civil Administration Bureau Procedures: For Shanghai Resident: (1) Permanent residence book and resident ID card (2) Testimonial of marital status (unmarried, divorce or bereft) issued by the employer, or sub-district office or the town government (validity: 3 months) (3) In case of going abroad on business or otherwise, they shall also provide testimonial of marital status issued by Chinese embassy or consulate in this country (4) In case of divorce, the original credentials of divorce are required: Certificate of Divorce, Certificate of Disengagement of Matrimonial Relationship and written conciliation statement or court judgment (accompanied by certificate of validity); The testimonial of divorce issued by a marriage registry office of a foreign country shall be certified by the Ministry of Foreign Affairs of such country or a competent authority authorized by it and the embassy or consulate of China in such country; The judgment or written conciliation statement by a foreign court shall not be valid until an intermediate court of China orders the recognition. (5) If the spouse of the applicant deceases in a foreign country, the applicant shall provide the original certificate of death of spouse certified by Chinese embassy or consulate in such country. For Overseas Chinese: (1) Passport and ID card of the country of residence (2) Certificate of unmarried status issued by the notary of the country of residence and certified by the Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country, or certificate of marital status issued by embassy or consulate of China in such country (validity: 6 months.) (3) Anyone who reaches the legal marital age before going abroad is required to provide certificate of unmarried status issued by the competent authority of his domicile or a notary deed for pledge of unmarried status before going abroad. (4) In case of divorce, the original credentials of divorce are required: Certificate of Divorce, Certificate of Disengagement of Matrimonial Relationship and written conciliation statement or court judgment (accompanied by certificate of validity); The testimonial of divorce processed by a marriage registry office of the foreign country shall be certified by its Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such foreign country; the divorce judgment or written conciliation statement by a foreign court shall not be valid until an intermediate court of China orders the recognition. (5) If the spouse of the applicant deceases in a foreign country, the applicant shall provide the original certificate of death of spouse certified by Chinese embassy or consulate in such country. (6) Evidence of employment For Hong Kong resident: (1) ID card of Hong Kong resident and pass for transit from Hong Kong, Macao to the Chinese mainland or seaman card; (2) Statement of no spouse issued by Marriage Registry Office of Hong Kong and verified by a lawyer in Hong Kong entrusted by the Department of Justice (valid for 3 months); (3) Anyone who reaches legal marital age before settling down in Hong Kong is required to provide certificate of unmarried status issued by the competent authority of his domicile or notary deed for pledge of unmarried status until leaving the Chinese mainland; (4) The original certificate of divorce in case of divorce: divorce judgment of a Hong Kong court required to be identified by a lawyer in Hong Kong entrusted by the Department of Justice; the divorce judgment or conciliation statement by a foreign court shall not be valid until certified by the Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country; the testimonial of divorce issued by a marriage registry office of the foreign country shall not be valid until certified by the Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country; (5) If the spouse of the applicant deceases in Hong Kong, the evidence of spouse bereaving shall be identified by a lawyer in Hong Kong entrusted by the Department of Justice; if the spouse of the applicant deceases in a foreign country, the evidence of spouse bereaving shall be certified by the Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country (6) Evidence of employment For Macao resident: (1) ID card of Macao resident and pass for transit from Hong Kong, Macao to the Chinese mainland or seaman card; (2) Testimonial of marital status issued by Marriage and Death Registry Board of Macao (valid for 3 months) (3) Anyone who reaches legal marital age before settling down in Macao is required to provide certificate of unmarried status issued by the competent authority of his domicile or notary deed for pledge of unmarried status until leaving the Chinese mainland; (4)The original certificate of divorce in case of divorce; the testimonial of divorce issued by a Macao court of law; the testimonial of divorce issued by a marriage registry office of the foreign country shall not be valid until certified by its Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country; the divorce judgment or conciliation statement by a foreign court shall not be valid until certified by its Ministry of Foreign Affairs or a competent authority authorized by it and the embassy or consulate of China in such country; (5) If the spouse of the applicant deceases in Macao, the applicant shall provide original evidence of spouse bereaving; if the spouse of the applicant deceases in a foreign country, the evidence of spouse bereaving shall be certified by its Ministry of Foreign Affairs or a competent authority authorized by it and the Chinese embassy or consulate in such country. (6) Evidence of employment The restoration of marriage shall comply with the fore-going provisions. Procedures: The would-be couple shall go to registration at a marriage registry office.
