Legislative Power

The NPC and its Standing Committee exercise the legislative power of the state as prescribed by the Constitution. The NPC enacts and amends criminal, civil, state institutional,?and other basic laws. The NPC Standing Committee enacts and amends laws other than those that should be enacted by the NPC; when the NPC is not in session, partially supplements and amends laws enacted by the NPC but without conflicting with the basic principles of those laws. The NPC may empower its Standing Committee to enact relevant laws. The laws adopted by the NPC and its Standing Committee shall be promulgated by a decree signed by the Chinese president.

In line with the conditions and needs of their respective administrative areas, the people's congresses of provinces, autonomous regions, and municipalities directly under the central government may enact and promulgate local regulations that do not contravene the Constitution, the law, and administrative regulations, and these new local regulations shall be reported to the NPC Standing Committee and the State Council for the record.

Likewise, the people's congresses of cities divided into districts and of autonomous prefectures may, within the limits of their authority as prescribed by the law, introduce local regulations that do not contravene the Constitution, the law, administrative regulations, and the regulations of their own provinces or autonomous regions. They shall report such new local regulations to the standing committees of their provincial or autonomous regional people's congresses for approval before implementation, and the said standing committees shall report this to the NPC Standing Committee and the State Council for the record. 

The people's congresses of provinces, autonomous regions, municipalities directly under the central government, cities divided into districts, and autonomous prefectures may jointly issue regulations that facilitate coordinated regional development. 

行使立法权

全国人民代表大会和全国人民代表大会常务委员会根据宪法规定行使国家立法权。全国人民代表大会制定和修改刑事、民事、国家机构的和其他的基本法律。全国人民代表大会常务委员会制定和修改除应当由全国人民代表大会制定的法律以外的其他法律;在全国人民代表大会闭会期间,对全国人民代表大会制定的法律进行部分补充和修改,但是不得

同该法律的基本原则相抵触。全国人民代表大会可以授权全国人民代表大会常务委员会制定相关法律。全国人民代表大会及其常务委员会通过的法律由国家主席签署主席令予以公布。

省、自治区、直辖市的人民代表大会根据本行政区域的具体情况和实际需要,在不同宪法、法律、行政法规相抵触的前提下,可以制定和颁布地方性法规,报全国人民代表大会常务委员会和国务院备案。设区的市、自治州的人民代表大会根据本行政区域的具体情况和实际需要,在不同宪法、法律、行政法规和本省、自治区的地方性法规相抵触的前提下,可以依照法律规定的权限制定地方性法规,报省、自治区的人民代表大会常务委员会批准后施行,并由省、自治区的人民代表大会常务委员会报全国人民代表大会常务委员会和国务院备案。省、自治区、直辖市以及设区的市、自治州的人民代表大会根据区域协调发展的需要,可以开展协同立法。
