Article 113 (Definition) For the purpose of this Act, the definitions of the following terms are:
"Greenhouse gases" refers to gases generated from human activities and coming into atmosphere that is enable or may lead to global and regional climate warming, including carbon dioxide, methane,nitrous oxide, hydro fluorocarbons, per fluorocarbons, sulfur hexafluoride, and other gaseous substances published by development and reform department of The State Council together with the environmental protection administrative department under The State Council. Carbon black can or could lead to global and regional climate warming, atmospheric particulate matter, this act is treated as a greenhouse gas. A specific list of greenhouse gases shall be released by the development and reform department of The State Council together with the environmental protection administrative department under The State Council.
"Climate change" refers to the climate change phenomenon which directly or indirectly changes the material composition of the Earth's atmosphere due to human activities and natural variability and affects human production and life. "Addressing climate change" refers to adaptation and mitigation measures taken to climate change impact caused or may caused by natural variability including legal, economic, administrative, technology, international cooperation and other means.
"Climate change deceleration" refers to the legal, economic, administrative, technology, international cooperation and other measures to reduce greenhouse gas emissions and increase carbon sinks, reduce or offset the losses or potential losses caused by climate change, efficient use of the benefits of climate change. "Climate change adaptation" refers to appropriate adjustment measures for the real or anticipated climate change to make the harm reduction or use of the benefits. "Energy conservation and emission reduction" refers to save energy and reduce greenhouse gas emissions. "The cap greenhouse gas emissions" refers to the total amount of greenhouse gas emissions discharged from the sources of emissions multiplied by the substances potential warming trend and represented by carbon dioxide equivalent. "Greenhouse gas emissions allowances" refers to allowed carbon dioxide equivalent amount from emissions recourse during a certain period and this amount shall come from the government's allocation, the internal bubble policy in enterprise or market transactions. "Greenhouse gas emissions allowances trading" refers to the sale or exchange of the greenhouse gas emissions on allowance trading platform at home and abroad. "The internal bubble policy in enterprise" refers to the policy that enterprises shall conduct new construction, renovation and expansion project by using emission allowances saved by energy conservation measures.
"Carbon sinks" refers to trees, forests, soil, marine, facilities or sites fixing carbon dioxide or other greenhouse gases when they leave the emission source or the release source. "Low-carbon standard" refers to emissions of carbon dioxide equivalent certified by the national authorities in accordance with the facilities, products or other units materials used or produced by the emission source or enterprises and institutions. "The key emissions unit" refers to the unit whose cap consumption of energy use and greenhouse gas emissions will be larger than a certain standard. Detailed criteria shall formulated by the development and reform department together with the environmental protection administrative department of The State Council.
"The key project" refers to new construction, renovation and expansion project whose cap consumption of energy use and greenhouse gas emissions will be larger than a certain standard. Article 114 (Efficacy of Act) Acts of resource, energy and environment shall coordinate with this act.
