More and more clubs or stores in industries such as fitness clubs, beauty salons, barbershops, carwashes and bookstores prefer prepaid services, said Qiu Baochang, director of the Consumer Protection Committee of the Beijing Lawyers Association. "But there are no laws or regulations in China to regulate such businesses requiring prepayments," Qiu said. The BLA has received many complaints about prepaid services when customers did not get their money back after the company closed. Consumer protection associations can only play a role in mediation and has no authority to punish companies. Qiu advised setting up a threshold for entry of business involving prepayment. He also urged such industries to disclose their operation status to their members. |
北京律师协会消费者权益保护专业委员会主任邱宝昌律师称,“预付款消费”在我国百货零售、休闲健身、美容美发、洗车和书店等行业盛行。“但是现在却没有相关法律条文监管预付款消费这一模式。”北京律师协会已经接到很多关于预付款消费的投诉,最终结果都是公司倒闭消费者未能拿回预付款。然而,消费者权益保护协会只能从中帮助调解,并无处罚权力。邱律师建议应该为这种消费模式设立准入门槛,商家也应该向会员公开公司内部经营情况。
